Empolotez Signature Firearms Terms & Conditions

All new firearms are subject to manufacturer’s warranty.
Transport of firearms to Australian purchasers must be to a Licensed Firearms Dealer (LFD)in the state in
which the buyer resides. That dealer will then require the purchaser’s firearms licence and acquisition
permit (PTA) details to complete your purchase.
All prices are in Australian dollars and include 10% Australian goods and services tax (GST)
NOTE: There are NO further permit brokerage fees for firearms purchased from Empolotez Signature
Firearms for the initial transaction,
The Below Relates to Firearms where they are Sold to or Purchased from a Third Party. However Freight will
be applicable if we are sending the Firearms that we have sold.
Fees – AMENSTY REGISTRATION – Receiving and The Customer Does Not Wish To Retain The Firearm and
Details of Who has handed it in is supplied.
FEE – Where the item holds Commercial Value and is purchased By Empolotez Signature Firearms from a

Fees – AMENSTY REGISTRATION – Receiving (where a customer wants to register a firearm in the
AMNESTY and have it transferred via PTA to their Current License and retain ownership)
FEE- includes 30 days storage while waiting for All Clear and PTA $75 inc GST Per Firearm
Storage after the 30 Days will be Calculated at a day rate of $1.10 inc GST Per Firearm Per Day
No Accessories will be Stored By Empolotez Signature Firearms unless bolted to the firearm, ie
scope/mounts, Accessories etc
Fees – Transfer Interstate – Receiving (where a customer has purchased their firearm from another
individual or dealer)
Receiving a Firearm for Transfer – includes 7 days storage $50 inc GST Per Firearm
Additional storage fees after the seven days $1.10 inc GST Per Firearm Per Day

Accuracy of Billing and Account Information
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel
quantities purchased per person, per household or per order. These restrictions may include orders placed
by or under the same customer account, the same credit card, and/or orders that use the same billing
and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to
notify you by contacting the e-mail and/or billing address/phone number provided at the time the order
was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed
by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases
made. You agree to promptly update your account and other information, including your email address and
credit card numbers and expiration dates, so that we can complete your transactions and contact you as
needed.
Optional Tools
We may provide you with access to third-party tools over which we neither monitor nor have any control

In no case shall Empolotez Signature Firearms, our directors, officers, employees, affiliates, agents,
contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any
direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without
limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages,
whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of
any of the service or any products procured using the service, or for any other claim related in any way to
your use of the service or any product, including, but not limited to, any errors or omissions in any content,
or any loss or damage of any kind incurred as a result of the use of the service or any content (or product)
posted, transmitted, or otherwise made available via the service, even if advised of their possibility.
Because some states or jurisdictions do not allow the exclusion or the limitation of liability for
consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the
maximum extent permitted by law.
Whilst every possible care is taken to ensure that the goods are suitable for the purpose intended,
Empolotez Signature Firearms accepts no responsibility for damage or injury to property or persons
resulting from sales or use of such goods.
Warranty on New Products
All new goods sold shall be warranted by the manufactures/importers warranty where so specified,
provided the manufacturer’s instructions are complied with in all aspects.
Any freight costs will be at the expense of the purchaser unless otherwise agreed upon.
All warranties are considered void if the goods are not used in a proper manner or used for a purpose for
which they were not designed or if repairs have been attempted by persons not authorised by Empolotez
Signature Firearms to carry out such repairs.
All Firearms will only be covered by Warranty if Factory Ammunition is used in the Firearm, Reloads will
void all applicable warranty.
Warranty on Used Firearms
Used firearms & Second Hand Accessories shall be subject to three (3) months warranty from the date of
taking delivery from Empolotez Signature Firearms or its agents.
Any freight and related costs for return of the goods to Empolotez Signature Firearms shall be at the
expense of the purchaser.
All warranties are considered void if the goods are not used in a proper manner or used for a purpose for
which they were not designed or if repairs have been attempted by persons not authorised by Empolotez
Signature Firearms to carry out such repairs.
All Firearms will only be covered by Warranty if Factory Ammunition is used in the Firearm, Reloads will
void all applicable warranty.
Payment

All On Line Sales must be paid in full, there are NO Laybys for On Line Sales.
Any items invoiced at discounted prices will revert to our standard list pricing if not paid for on or before
the due date shown on the invoice. 
Layby (Email / Phone Purchases Only)
ALL GOODS SOLD ON “LAY-BY” BASIS SHALL BE SUBJECT TO THE FOLLOWING CONDITIONS:

1. Minimum Deposit of 25% of the total purchase price shall be payable at the time of the original
   purchase.
2. Fortnightly instalments are to be approx. 25% of the total value.
3. The balance shall be payable by fortnightly instalments over a term of eight (8) weeks.
4. Any purchases cancelled shall be liable to a cancellation fee of 20% of the total purchase price
   which will be deducted from any refund payable on cancellation of the purchase. Any refund due
   will only be valid for cancellations made within the specified lay-by period.  All cancellations made
   outside of the 8 week lay buy period because of non-finalisation, by management or by the
   purchaser, all funds paid to Empolotez Signature Firearms for the relative lay buy will be retained
   by Empolotez Signature Firearms, for administration, maintenance of the product, warehousing of
   the product, re-stocking of the product and re advertising of the product for re-sale, THERE WILL BE
   NO REFUND.
5. Administration charges $33 + GST = $36.30 (minimum).
6. Cancellations due to LEGAL PRECLUSION shall, on written official substantiation thereof, be
   refunded in full.
7. Goods partially or wholly paid for will be stored by us for a period of 16 weeks at no charge.
   Thereafter a storage fee of $36.30 per month per firearm and $36.30 per month per order will
   apply. Unclaimed goods or goods not purchased in accordance with these terms and conditions can
   be disposed of at Empolotez Signature Firearms discretion after the said 16 weeks to recover
   storage and administration costs.
8. Property in any goods supplied by Empolotez Signature Firearms will not pass to the purchaser until
   such time as the goods have been paid for in full and all monies owed to Empolotez Signature
   Firearms paid in full.
9. A Sale is a “LAY-BY” for All Invoices with outstanding Balances where a deposit has been paid.
   Any items invoiced at discounted prices will revert to our standard list pricing if not paid for on or before
   the due date shown on the invoice.
   Paid In Full Invoices & Cancellation of Paid In Full Invoices
10. Any paid in full purchases cancelled shall be liable to a cancellation fee of 20% of the total purchase
    price which will be deducted from any refund payable on cancellation of the purchase for a re-
    stocking fee, this does NOT include back ordered items. Any refund due will only be valid for
    cancellations made within the specified period of 8 weeks from date of purchase. Once this time
    has passed an invoice will not be refunded.
11. Administration charges $33 + GST = $36.30 (minimum).

14. Property in any goods supplied by Empolotez Signature Firearms will not pass to the purchaser until
    such time as the goods have been paid for in full and all monies owed to Empolotez Signature
    Firearms paid in full.
15. This Section Applies Only to Goods that have NOT been collected from us or Sent Out via
    Transport/Post.
    Cancellations Of Back Ordered Items
16. Cancellations and Refunds of Back Ordered Items will incur a SMALL Administration fee of up to $36.30
    inc GST if cancelled within 30 Days to cover associated processing costs.
17. Special Order Items where stipulated on invoice will not be cancelled as they have been specifically
    ordered for the customer.
    Transfer of Property Rights
    Property in any Firearm sold does not pass to the PURCHASER until presentation and finalisation of a Valid
    Permit to Acquire (PTA), all requirements of the Weapons Act 1990 have been satisfied and the goods have
    been paid for in full and all monies owed to Empolotez Signature Firearms paid in full.
    Returns and Refunds
18. NO CREDITS, REFUNDS OR EXCHANGES OF PRODUCTS WILL BE ISSUED WITHOUT PRODUCTION OF
    ORIGINAL SALES VOUCHER OR TAX INVOICE.
19. Returned Goods must be in ORIGINAL UNDAMAGED/MARKED CONDITION IN FACTORY
    PACKAGING.
20. Refunds will not be applicable for a “change of mind” on your purchase.
21. Refunds, Exchange and Returns will only be accepted and authorised within a period of 30 days of
    the original Date of Purchase and do not apply to Special Ordered Items.
    Please Note: We are happy to process refunds, where applicable, if ALL of the above conditions are
    complied with.
    Indemnification
    You agree to indemnify, defend and hold harmless Empolotez Signature Firearms and our parent,
    subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers,
    subcontractors, suppliers, interns and employees, harmless from any claim or demand, including
    reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of
    Service or the documents they incorporate by reference, or your violation of any law or the rights of a
    third-party.
    Severability
    In the event that any provision of these Terms of Service is determined to be unlawful, void or
    unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by
    applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service,
    such determination shall not affect the validity and enforceability of any other remaining provisions.

Termination
The obligations and liabilities of the parties incurred prior to the termination date shall survive the
termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate
these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you
cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of
these Terms of Service, we also may terminate this agreement at any time without notice and you will
remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny
you access to our Services (or any part thereof).
Entire Agreement
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a
waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The
Service constitutes the entire agreement and understanding between you and us and govern your use of
the Service, superseding any prior or contemporaneous agreements, communications and proposals,
whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms
of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting
party.
Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed
by and construed in accordance with the laws of Victoria, Australia.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service

Your Account
If you use this site, you are responsible for maintaining the confidentiality of your account and password

occur under your account or password. Empolotez Signature Firearms does not sell products to minors /
children, but it sells them to adults, who can purchase with a credit card or Direct Bank Transfer. If you are
under 18, you may use Empolotez Signature Firearms only with involvement of a parent or guardian.
Empolotez Signature Firearms reserve the right to refuse service, terminate accounts, remove or edit
content, or cancel orders in their sole discretion.
License And Site Access

Empolotez Signature Firearms grants you a limited license to access and make personal use of this site and
not to download (other than page caching) or modify it, or any portion of it, except with express written
consent of Empolotez Signature Firearms. This license does not include any resale or commercial use of this
site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use
of this site or its contents; any downloading or copying of account information for the benefit of another
merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This site or any
portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited
for any commercial purpose without express written consent of Empolotez Signature Firearms. You may
